1. Scope

These Terms of Service govern access to and use of:

The paid Insights service is intended only for businesses and professionals. A person creating or administering a workspace represents that they act in a professional capacity and have authority from the relevant organization.

These Terms apply when accepted by or incorporated into an agreement with the relevant business customer. Merely viewing the public corporate website does not by itself create a paid-service contract.

3. Description of Services

3.1 Corporate Website

The website presents Magnus Opera’s activities, products, and services. Google Analytics is used on the public websites magnusopera.io and terrabuild.io to measure audience and understand how the websites are used. Google Analytics is not installed or used on the Insights application at insights.magnusopera.io. Magnus Opera does not display advertising on these websites or use analytics data for advertising. The related processing is described in the Privacy Policy.

3.2 Insights Application

Insights is a SaaS platform allowing:

  • User account creation
  • Creation and administration of team workspaces
  • Subscription to service and storage plans
  • Encrypted managed-artifact storage for Terrabuild
  • Collection and presentation of build, repository, delivery, cache, and usage metadata
  • Optional synchronization with a customer-authorized GitHub App

Access requires an active account.

The application is hosted on Cloudflare infrastructure. Its D1 databases and R2 storage buckets are configured with Cloudflare’s European Union jurisdiction restriction. Certain providers may nevertheless process limited personal data outside the European Economic Area under the safeguards described in the Privacy Policy.

3.3 Terrabuild

Terrabuild is freely usable software.

Server-side storage requires an Insights subscription.

The source code is publicly available under the Functional Source License (FSL).

The “Terrabuild” trademark is owned exclusively by Magnus Opera.

Sentry may process minimized technical error and performance information to diagnose and improve service stability. This information is not represented as anonymous and is handled as described in the Privacy Policy.

4. Data Responsibility

Terrabuild enables storage of managed build artifacts and the transmission of build metadata to Insights.

Terrabuild compresses and encrypts managed artifact contents locally before upload. The corresponding master key is not sent to Insights, and Magnus Opera cannot decrypt those artifact contents server-side. Build, repository, delivery, identity, usage, billing, and artifact-index metadata is not covered by that client-side encryption statement and remains readable by Insights so that the service can operate.

Users remain solely responsible for:

  • The content of stored data
  • Its legality
  • Compliance with applicable regulations

Even encrypted data must be lawful.

Users acknowledge that managed artifacts are intended for build and delivery workflows and should not be the sole copy of critical operational data.

Magnus Opera shall not be liable for any data loss.

5. Security and Credential Responsibility

Access to the Insights service via Terrabuild requires authentication tokens and API credentials.

Users are solely responsible for safeguarding:

  • Access tokens
  • API credentials
  • Any authentication secrets
  • Encryption secrets used to encrypt stored data

Terrabuild implements client-side encryption.
Encryption secrets are generated and controlled exclusively by the user.

Magnus Opera:

  • Does not have access to encryption secrets
  • Does not store encryption secrets
  • Cannot recover encryption secrets
  • Cannot decrypt stored data

If a user loses their encryption secret, the associated data cannot be decrypted or restored.

If a token, credential, or encryption secret is compromised due to user negligence, improper storage, insufficient security practices, or third-party exposure, Magnus Opera shall not be held liable for any resulting loss, unauthorized access, or data exposure.

Users are responsible for implementing appropriate technical and organizational measures to protect credentials and encryption secrets.

6. Accounts

Users must provide accurate information.

Users are responsible for maintaining confidentiality of credentials.

Magnus Opera may suspend or terminate access in case of:

  • Breach of these Terms
  • Fraudulent activity
  • Illegal use
  • Payment failure via Stripe

7. No SLA

No Service Level Agreement (SLA) is guaranteed.

Services are provided “as is”.

8. Service Evolution

Magnus Opera reserves the right to modify, improve, or discontinue features of the services at any time.

Such changes shall not constitute a contractual modification or give rise to compensation.

9. Prohibited Use

Users may not:

  • Engage in unlawful activities
  • Store illegal content
  • Use the storage service for purposes unrelated to Terrabuild build outputs
  • Attempt to compromise or overload the service
  • Circumvent technical limitations
  • Reverse engineer the service beyond what is permitted by law

10. Limitation of Liability

Magnus Opera’s total liability, for all claims combined, shall in no event exceed the total amount paid by the user during the three (3) months preceding the event giving rise to liability.

Magnus Opera shall not be liable for:

  • Indirect damages
  • Loss of business
  • Revenue loss
  • Loss of profits
  • Loss of data

This limitation does not apply in cases of gross negligence (faute lourde), willful misconduct (dol), or liability that cannot be excluded under applicable law.

11. Third-Party Services & Force Majeure

Depending on the features used, services rely on third parties including:

  • Cloudflare
  • Stripe
  • Mailgun
  • Sentry
  • GitHub
  • Google, for website analytics and restricted backoffice administrator authentication

Magnus Opera shall not be liable for disruptions caused by these providers.

Their processing of personal data is described in the Privacy Policy.

Liability is excluded in cases of force majeure under French law.

12. Governing Law

These Terms are governed by French law.

Any dispute shall fall under the jurisdiction of French courts.
