1. Scope

These Terms of Service govern access to and use of:

By accessing or using the services, the user agrees to be bound by these Terms.

3. Description of Services

3.1 Corporate Website

The website presents Magnus Opera’s activities, products, and services.

Google Analytics may be used to collect aggregated and anonymized audience metrics in order to understand website usage and improve the service. Personal identification of users is not performed.

3.2 Insights Application

Insights is a SaaS platform allowing:

  • User account creation
  • Subscription to storage plans
  • Storage of Terrabuild-related build data

Access requires an active account.

3.3 Terrabuild

Terrabuild is freely usable software.

Server-side storage requires an Insights subscription.

The source code is publicly available under the Functional Source License (FSL).

The “Terrabuild” trademark is owned exclusively by Magnus Opera.

Sentry may be used to collect anonymized technical error reports in order to diagnose and improve the stability of the application. These reports are intended for debugging purposes only.

4. Data Responsibility

Terrabuild enables storage of build output data.

Data is encrypted client-side. Magnus Opera has no technical ability to decrypt it server-side.

Users remain solely responsible for:

  • The content of stored data
  • Its legality
  • Compliance with applicable regulations

Even encrypted data must be lawful.

Users acknowledge that stored data is intended solely for build optimization purposes and does not constitute critical operational data.

Magnus Opera shall not be liable for any data loss.

5. Security and Credential Responsibility

Access to the Insights service via Terrabuild requires authentication tokens and API credentials.

Users are solely responsible for safeguarding:

  • Access tokens
  • API credentials
  • Any authentication secrets
  • Encryption secrets used to encrypt stored data

Terrabuild implements client-side encryption.
Encryption secrets are generated and controlled exclusively by the user.

Magnus Opera:

  • Does not have access to encryption secrets
  • Does not store encryption secrets
  • Cannot recover encryption secrets
  • Cannot decrypt stored data

If a user loses their encryption secret, the associated data cannot be decrypted or restored.

If a token, credential, or encryption secret is compromised due to user negligence, improper storage, insufficient security practices, or third-party exposure, Magnus Opera shall not be held liable for any resulting loss, unauthorized access, or data exposure.

Users are responsible for implementing appropriate technical and organizational measures to protect credentials and encryption secrets.

6. Accounts

Users must provide accurate information.

Users are responsible for maintaining confidentiality of credentials.

Magnus Opera may suspend or terminate access in case of:

  • Breach of these Terms
  • Fraudulent activity
  • Illegal use
  • Payment failure via Stripe

7. No SLA

No Service Level Agreement (SLA) is guaranteed.

Services are provided “as is”.

8. Service Evolution

Magnus Opera reserves the right to modify, improve, or discontinue features of the services at any time.

Such changes shall not constitute a contractual modification or give rise to compensation.

9. Prohibited Use

Users may not:

  • Engage in unlawful activities
  • Store illegal content
  • Use the storage service for purposes unrelated to Terrabuild build outputs
  • Attempt to compromise or overload the service
  • Circumvent technical limitations
  • Reverse engineer the service beyond what is permitted by law

10. Limitation of Liability

Magnus Opera’s total liability, for all claims combined, shall in no event exceed the total amount paid by the user during the three (3) months preceding the event giving rise to liability.

Magnus Opera shall not be liable for:

  • Indirect damages
  • Loss of business
  • Revenue loss
  • Loss of profits
  • Loss of data

This limitation does not apply in cases of gross negligence (faute lourde), willful misconduct (dol), or liability that cannot be excluded under applicable law.

11. Third-Party Services & Force Majeure

Services rely on third parties including:

  • Microsoft Azure
  • Stripe
  • Mailgun
  • Google Analytics
  • Sentry

Magnus Opera shall not be liable for disruptions caused by these providers.

Liability is excluded in cases of force majeure under French law.

12. Governing Law

These Terms are governed by French law.

Any dispute shall fall under the jurisdiction of French courts.
