Terms and Conditions of Sale

1. Purpose
These Terms govern subscription to the “Insights – Storage for Terrabuild” service.
Terrabuild is freely usable software.
Paid subscription applies exclusively to server-side storage services.
2. Customer Types
The service is available to:
- Business customers (B2B)
- Individual consumers (B2C)
The customer confirms having legal capacity to subscribe.
3. Plans
- Free – 10 MB – Free
- Starter – 5 GB – €9/month + VAT if applicable
- Team – 50 GB – €49/month + VAT if applicable
Prices are expressed in euros and exclude applicable taxes unless otherwise stated. Value Added Tax (VAT) or other applicable taxes may be added depending on the customer’s location and status.
Trial periods may be offered for certain plans. Eligibility and duration may vary depending on the offer and the user’s account history.
4. Payment
Payment is processed exclusively via Stripe.
Payment is due at the beginning of each billing cycle.
No refunds are issued, including in case of early termination.
Upgrades are prorated. Downgrades take effect at the end of the billing cycle.
Failure of payment may result in suspension without notice.
5. Duration and Termination
Subscriptions are monthly and automatically renewed.
Termination takes effect at the end of the current billing period.
Magnus Opera may terminate access in case of violation of the Terms.
6. Data Ownership and Usage
Stored data must strictly correspond to build outputs generated by Terrabuild.
Any other use may result in immediate termination.
Customers retain ownership of their data.
Export is available via the Insights interface.
Permanent deletion may be requested via the interface.
Magnus Opera is not liable for data loss.
7. Support
Support is included in paid subscriptions.

8. Limitation of Liability
Magnus Opera’s total liability, for all claims combined, shall in no event exceed the total amount paid by the customer during the three (3) months preceding the event giving rise to liability.
This limitation does not apply in cases of gross negligence, willful misconduct, or liability that cannot be excluded under applicable law.
Magnus Opera shall not be liable for indirect damages or data loss.
9. Consumer Right of Withdrawal (B2C)
In accordance with Article L221-28 of the French Consumer Code, the consumer expressly waives the right of withdrawal once the service has begun execution before the end of the statutory period, notably upon immediate account activation.
10. Data Protection
Collected data:
- Username
- Login timestamps
Purpose: authentication and service security.
No analytics tracking.
Authentication cookie only.
Payment data processed exclusively by Stripe.
Subprocessors: Stripe, Microsoft Azure.

11. Governing Law and Jurisdiction
These Terms are governed by French law.
For business customers, exclusive jurisdiction is granted to the courts of Versailles.
For consumers, mandatory legal jurisdiction rules apply.
